The Law must reflect and walk together with the evolutions and changes of society, and absorb virtues that elevates the collective, protecting goods and encouraging good conducts. As an example, in brazilian Criminal Law we have the crime of "omission of help", and according to the author Cezar Roberto Bitencourt, in his book Treatise on Criminal Law, volume 2, in the article that regulates this crime, “the protected legal asset is, like the previous articles, the preservation of human life and health, and the basis for the criminalization of failure to provide assistance is the disrespect for the duty of solidarity, a moral principle erected, by that device, to the condition of legal duty. ” We see then that the duty of human solidarity was a moral principle converted into a legal duty into a penal rule. Going further, the virtue of solidarity was erected as a legal duty.

This elevation to a legal duty of human solidarity can be used as a parallel to the judgment and a social dimension of sustainability. When virtues and moral principles are dealt more directly and effectively, we have an incentive to healthy social relations. Sustainability is not only about the natural environment, but also about culture and work. A degrading practice like "rinha de galos" in no way contributes to the development of human virtues and potentialities, and banning it promotes the flourishing of other activities that are, in fact, constructive.

Continuing now from an economic perspective, some authors understand, such as Ludwig von Mises, that economics are human action, that is, the economy materializes through the actions of individuals, who act with determined objectives, generating wealth and developing society. Under the perspective of sustainability, we have the imperative that these actions of individuals must be guided taking into account the effects and consequences on a long-term view of their actions.

The idea of sustainability in the economy also leads us to observe, as Juarez Freitas says in the book “Sustainability, Right to the Future”, that are the good investments in education of individuals, helping them to have a dignified life and raise their standards of life that will make all the difference about a society concerned with environmental issues, making policies such as circular economy, reduction of carbon emissions and better sanitation more viable and effective.

In conclusion, the judgment quoted at the beginning of the text reflects the adoption of the holistic lens to see and read the world, this does not mean that we will abandon Cartesian rationality, but integrate it into a system whose purpose is to promote a more supportive and comprehensive view of the world, in which we consider all forms of life to be important and worthy of protection and respect.

O Direito deve refletir e acompanhar as evoluções e mudanças da sociedade, e colocar em si virtudes que elevem o coletivo, protegendo bens jurídicos e incentivando boas condutas. Como exemplo, no Direito Penal temos o crime de omissão de socorro, segundo o autor Cezar Roberto Bitencourt, em seu livro Tratado de Direito Penal, volume 2, neste tipo penal, “o bem jurídico protegido é, a exemplo dos artigos anteriores, a preservação da vida e da saúde do ser humano, e o fundamento da criminalização da omissão de socorro é o desrespeito ao dever de solidariedade humana, um princípio moral erigido, por esse dispositivo, à condição de dever jurídico.” Vemos então que o dever de solidariedade humana foi um princípio moral convertido em dever jurídico numa norma penal. Indo além, a virtude da solidariedade foi erigida em dever jurídico.

Esta elevação a dever jurídico de um dever de solidariedade humana pode ser utilizado como um paralelo para o julgado e uma dimensão social da sustentabilidade. Na medida em que virtudes e princípios morais são tratados de forma mais direta e efetiva, temos um incentivo a relações sociais saudáveis. A sustentabilidade não diz respeito apenas ao meio ambiente natural, mas também cultural e do trabalho. Uma prática degradante como rinha de galos em nada contribui para o desenvolvimento das virtudes e potencialidades humanas, e bani-lo promove o florescimento de outras atividades que sejam, de fato, construtivas.

Continuando agora sob uma perspectiva econômica, compreendem alguns autores, como Ludwig von Mises, que a economia é ação humana, ou seja, a economia se materializa mediante ações de indivíduos, que agem com objetivos determinados, gerando riquezas e desenvolvendo a sociedade. Sob a perspectiva da sustentabilidade, temos o imperativo que estas ações dos indivíduos devem ser pautadas levando em conta os efeitos e consequências a longo prazo de seus atos.

O raciocínio da sustentabilidade na economia também nos leva a observar, como diz Juarez Freitas no livro “Sustentabilidade, Direito ao Futuro”, que são os bons investimentos em educação dos indivíduos, ajudando-os a terem uma vida digna e elevarem seus padrões de vida que fará toda diferença quanto a uma sociedade preocupada com questões ambientais, tornando mais viável políticas como economia circular, redução das emissões de carbono e saneamento.

Concluindo, o julgado citado no início do texto é reflexo da adoção da lente holística para ver e interpretar o mundo, isso não significa que vamos abandonar a racionalidade cartesiana, mas integrá-la a um sistema cuja finalidade é promover uma visão mais solidária e abrangente do mundo, na qual consideramos todas as formas de vida como importantes e merecedoras de proteção e respeito.
