We condemn the Export-Import Bank of Korea for enforcing the construction of the Jalaur Mega Dam, regardless of the opposition of the indigenous people and the concerns over safety issues.

Existence of the risk of earthquakes, lack of procedural justification, and destruction of the environment makes the project unjustifiable.

The tragic accident of the Laos dam should never happen again. The construction should be halted and reexamined.

On September 3, 2018, the National Irrigation Administration (NIA) of the Philippines and Daewoo Engineering & Construction Co. (Daewoo E&C) announced that they had signed the main contract for The Jalaur Multipurpose Project Phase 2 (JRMPII), and that the construction would start during the first week of October 2018. However, they are enforcing the construction of the large dam regardless of the opposition and concerns of indigenous people and civil associations. The working expense of the JRMPII reaches a total of $193,000,000 and is the largest credit assistance in the history of the Economic Development and Cooperation Fund (EDCF) of Korea. It is a loan contract between Daewoo E&C and the Philippine Government. The project is the first one to apply the ‘Safeguard’ of EDCF, which was established to prevent violations of indigenous people’s rights. However, the feasibility study report and the environmental-social impact assessment report of the project is being withheld, and indigenous people are constantly raising safety issues. We, the People's Solidarity for Participatory Democracy (PSPD), denounce the Export-Import Bank of Korea for distressing the indigenous people with the taxpayer-generated Official Development Assistance (ODA), and demand an overall reexamination of this project as well as the discontinuation of further financial support.

The Jalaur Multipurpose Project Phase 2 (JRMPII) consists of constructing i) 3 dams in the city of Iloilo including a 109-meter Jalaur High Dam, ii) 81km of Highline Canal, and iii) an irrigation facility which covers an estimated 31,840 hectares. However, the project area is known to be on an active fault which means the risk of an earthquake occurring is high. The NIA stated that: “The project area contacts with Panay fault along Antique range on the west and another thrust fault runs parallel to Panay fault. But, these faults are inactive and have no vestiges of movement.” The Export-Import Bank of Korea also insists that there are no safety issues, and the construction plan applies a more rigorous standard of earthquake-resistant design. However, according to the Philippine Institute of Volcanology and Seismology (PHIVOLCS), there have been 22 earthquakes detected since January 2017 in Iloilo. The fact that the West Panay Fault caused one of the most catastrophic earthquakes in the country in 1948, a magnitude 8.2 earthquake named “Lady Caycay”, also warns of the danger of building a 109-meter mega dam over this fault.

JRMPII is also violating the domestic law of the Philippines. According to the Indigenous Peoples Rights Act of 1997 (IPRA Law), the Philippines government should ensure the indigenous people’s rights. Therefore, the NIA should follow the Free, Prior and Informed Consent (FPIC) procedure, and obtain unanimous consent before starting. However, according to the opposing indigenous people, the consent was not “free” because information from affected indigenous people in communities reveal that the NIA engaged in “giving incentives” through menial job hiring of people who resist or are reluctant to give consent to the project. According to the FPIC Guidelines (2006), the National Commission on Indigenous Peoples (NCIP) must respect the “consent/non-consent” decision of the indigenous people and follow their decision. However, on the conduct of the second FPIC, three indigenous communities submitted a non-consent each, while only one resolution was recorded in the final copy of the document. Not even the application of FPIC was not on time. The Export-Import Bank of Korea, however, is neglecting these issues on purpose and is insisting that there are no problems.

Additionally, if the Jalaur Dam is completed, 16 villages, an estimated 17,000 people would be affected. Three of the villages would be inundated completely. However, the Philippine government does not have a clear plan for the displaced people, even regarding housing facilities and amenities. Compensation for the loss is also inadequate. A member of the indigenous people who visited Korea in April to notify the problem of Jalaur said that there was a case where the compensation for 1 hectare of land was only 1,800 Pesos. Like this, local residents are signing the consent form under the Philippine governments’ pressure.

The Korean Government established a ‘Safeguard’ policy in credit assistance following the international legal standards to prevent human rights violation and environmental destruction. The JRMPII is the first project to apply the EDCF Safeguard. Nonetheless, the issues regarding opposition, concerns of the indigenous people and the plan for the displaced people are still not resolved. Last April, in a meeting with indigenous people and activists, EDCF announced that conforming to the safeguard, if the alternative plan won’t be fulfilled, they would stop the ODA. The principle of the World Bank (WB) and the Asian Development Bank (ADB) is to abandon projects that don’t fit the safeguard standards. When a project doesn’t follow the environmental and social laws of the receiving country, it must be suspended. The Export-Import Bank of Korea should reexamine whether the JRMPII feasibility study, environmental-social impact assessment, and the overall procedure of the project are in line with the Safeguard policy of EDCF. Likewise, EDCF must check whether the Philippine government has established both a system which prevents human rights violations and a counterplan which can relieve the concerns.

We learned from the tragedy of Laos that a national tax-funded ODA, which is created to reduce the poverty of developing countries and to improve the human rights, can destroy the lives of indigenous people completely. Residents and civic groups have been demanding a comprehensive assessment of the structural integrity of the dams, impact on ecosystems, socio-economic impacts of communities affected directly or indirectly by dam construction, and comprehensive alternatives to large dams, but this was all disregarded. ODA should be conducted carefully by respecting the opinions of residents and closely evaluating the impacts of the project. Now it’s time for the Export-Import Bank of Korea to stop funding the project and start to find another alternative with the Philippine government.

필리핀 할라우댐 건설 강행하는 수출입은행 규탄

지진 발생 위험성, 절차적 정당성 결여, 환경 파괴 등의 문제 상존

라오스 댐 사고 반복되어서는 안돼, 중단하고 재검토해야

지난 9월 3일, 필리핀 관개청과 대우건설은 ‘필리핀 할라우강 다목적사업(2단계)’ 본계약을 체결하고, 이르면 10월 첫째주부터 댐 건설 공사에 착수한다고 밝혔다. 현지 주민, 시민사회단체의 반대와 안전성 우려 등을 무시한 채 결국 대형댐 건설을 강행하는 것이다. 총 사업비 1억 9300만 달러(약 2,061억 원)의 이번 사업은 한국수출입은행 대외경제협력기금(EDCF)이 한국 유상원조 사상 최대 규모로 필리핀 정부와 차관 계약을 맺어 진행되는 것이다. 해당 사업은 대규모 개발원조사업이 미치는 악영향을 예방하고 지역 주민의 권리를 보호하기 위한 EDCF의 ‘세이프가드’가 처음 적용되었지만, 사업타당성 조사보고서, 환경사회영향평가보고서 등 관련 정보는 공개되지 않고 있으며, 댐 건설과 관련된 안전성 문제는 현지에서 지속적으로 제기되고 있다. 참여연대는 국민의 세금으로 조성된 공적개발원조(ODA)로 현지 주민들을 오히려 고통에 빠뜨리고 있는 한국수출입은행을 규탄하며, 자금 지원을 중단하고 사업을 지금이라도 전면 재검토할 것을 요구한다.

필리핀 할라우강 다목적사업(2단계)은 일로일로(Iloilo)주에 할라우하이댐(높이 109m) 등 3개의 댐과 81km의 도수로, 31,840ha에 걸친 관개시설을 건설하는 사업이다. 그러나 댐 건설 예정지역은 활성 단층이 지나는 위치에 있어 지진 발생 위험성이 높다고 알려져 있다. 해당사업을 추진하는 필리핀 관개청(NIA)은 웨스트 파나이(West Panay) 활성 단층이 현재는 ‘휴면 상태’로 ‘움직임에 대한 흔적을 찾을 수 없다’고 밝히고 있다. 한국 수출입은행 역시 댐 안전성에 별다른 문제가 없으며, 댐 설계 시 해당 지역의 내진 기준보다 엄격한 내진 설계를 반영하여 문제가 없다고 주장하고 있다. 그러나 필리핀 화산지진연구소(PHIVOLCS)에 따르면 2017년 1월부터 현재까지 사업 지역인 일로일로주에서 총 22차례의 지진이 감지되었다. 또한 1948년 파나이섬 최악의 지진 중 하나였던 진도 8.2의 ‘레이디 케이케이(Lady Caycay)’ 지진이 웨스트 파나이 활성 단층에 의해 발생했다는 사실을 상기할 때, 이 지역에 높이 109m의 대형댐을 건설한다는 것은 매우 위험한 일이다.

또한 해당 사업은 추진과정에서 필리핀 국내법을 위반하고 있다. 필리핀은 1997년 제정된 선주민권리법(IPRA)에 따라 선주민의 권리를 보장해왔으며 선주민 거주지역에서 개발사업을 착수할 때는 ‘자유의사에 따른 사전인지동의(FPIC)’ 절차를 밟아야 한다. 여기서 만장일치 동의를 받아야만 사업 착수가 가능하다. 그러나 반대 주민들은 할라우댐 건설 사업의 사전인지동의를 얻는 과정 자체도 사업을 찬성하는 사람들에 의해 조작되었다고 주장하고 있다. 필리핀 관개청이 사업을 반대하거나 찬성을 주저하는 주민들에게 인센티브를 제공하여 FPIC 과정에 관여하였다는 것이다. FPIC 가이드라인(2006)에 따르면, 선주민위원회(NCIP)는 선주민의 ‘동의/비동의’ 결정을 존중하고 선주민의 결정에 따라 사업 진행 여부를 결정하도록 하고 있다. 그러나 FPIC 획득 과정에서 3개 마을이 비동의(non-consent)를 제출했음에도 1개 마을의 비동의만 접수되었고, FPIC 시행 시점이 절차에 맞지 않는 등 여러 문제가 있었다. 그럼에도 불구하고 한국수출입은행은 FPIC 획득 과정의 문제를 인지했음에도 절차적 문제가 없다고 주장하고 있다.

문제는 이뿐만이 아니다. 할라우댐이 건설되면 총 16개 마을, 약 1만 7천 명의 선주민들의 삶에 직간접적인 영향을 받게 된다. 이 중 3개 마을은 완전히 수몰될 예정이다. 그럼에도 불구하고 필리핀 정부는 비자발적 이주민에 대한 대책을 충분히 마련하지 못하고 있다. 진입로 및 댐 공사로 농경지와 거주지를 잃게 될 피해 선주민들의 입주 주택 및 주변 편의 시설은 마련되지 않았다. 거주지는 물론 농경지까지 잃은 주민들에 대한 보상 역시 미비하다. 지난 4월 할라우댐 문제를 알리기 위해 한국을 방문했던 선주민은 댐 공사를 위한 도로 공사 때문에 1헥타르(3025평)에 이르는 땅을 정부에 넘겨줘야 했지만, 보상금으로 1,800페소(약 3만 6천원)밖에 받지 못한 사례가 있다고 전하기도 했다. 이처럼 지역 주민들은 필리핀 정부의 이주 압박에 못 이겨 이주 동의서에 서명하고 있는 상황이다.

한국 정부는 국제기준에 따른다는 명분으로 대규모 유상원조 사업에서 인권침해, 환경파괴 문제가 계속되자 ‘세이프가드’를 수립하였다. 필리핀 할라우강 다목적사업(2단계)는 EDCF 세이프가드를 적용하는 첫 번째 사업이다. 그럼에도 불구하고 지역 주민들의 반대와 우려, 비자발적 이주민에 대한 대책 미비 등 여전히 문제점은 해결되지 않았다. 지난 4월 필리핀 지역 주민과 활동가들과의 면담 자리에서 EDCF는 “EDCF 세이프가드에 따라 대책, 대안이 이행되지 않을 경우 자금 지원을 중단하겠다”고 밝힌 바 있다. 세계은행(WB)과 아시아개발은행(ADB)은 세이프가드 정책에 부합하지 않는 사업은 지원하지 않고, 차관을 받는 국가의 사회, 환경과 관련된 법률을 준수하지 않는 경우 사업을 진행하지 않는 것을 원칙으로 하고 있다. 수출입은행은 할라우강 다목적사업(2단계)의 타당성 조사와 환경사회영향평가를 비롯해 사업 과정 전반이 EDCF의 세이프가드에 부합하는지 전면 재검토해야 마땅하다. 또한, 필리핀 정부가 해당 지역 주민들과 충분한 협의를 통해 공사 피해와 인권침해를 예방하는 제도를 갖추었는지, 제기된 우려에 대한 대응 방안을 충분히 마련했는지 확인해야 한다.

우리는 라오스 세피안-세남노이 댐 사고를 통해 개도국의 빈곤 감소, 인권 향상 등 인도주의 실현을 위해 국민 세금으로 조성된 ODA가 지역 주민의 삶을 송두리째 빼앗아 버릴 수도 있다는 사실을 확인하였다. 그동안 현지 주민들과 시민단체들은 댐의 구조 건전성, 생태계에 미치는 영향, 댐 건설로 인해 직간접적 영향을 받는 선주민 공동체들의 사회·경제적 영향까지를 포함한 독립적인 타당성 조사와 대형댐을 대체할 대안에 대해 포괄적인 평가를 시행하자고 요구했으나 이는 외면되었다. 대규모 개발협력사업은 현지 주민들의 의견을 존중하고 사업이 미칠 영향을 면밀히 평가하여 신중하게 진행되어야 한다. 한국수출입은행은 지금이라도 자금 지원을 중단하고, 필리핀 정부와 다른 대안을 검토해야 한다.
